When workers employed by a subcontractor or a partner company which provides the operation and maintenance service to power plants submitted a mediation request to the Labor Relations Commission due to the breakdown of collective bargaining, the company in response made an application to the Labor Relations Commission to approve the 100 percent of the workforce it hired as the necessary level to maintain the minimum operation service to effectively block an industrial action.

According to the Article 42-4 of the Trade Union and Labor Relations Adjustment Act regarding the decision on the levels of minimum service maintenance and operation, if an agreement on the maintenance and operation levels of minimum services is not concluded, both or either side of the parties in labor relations shall make an application for the Labor Relations Commission to decide the levels of minimum service maintenance and operation, specific work designated as minimum services, and the necessary number of workers.

The company's request to the Labor Relations Commission can be interpreted paradoxically that all the contingent workers are the necessary workforce for the maintenance and operation of the minimum services in the power plants. Criticisms have been growing on the excessive restriction on the basic labor rights for the power plant contingent workers who are now hired by private companies due to the outsourcing policy of the previous administrations.

Having denounced the insincere attitude of the company in the collective bargaining and mediation process, KPTU demanded that "if the work of the operation and maintenance of power plants is in deed recognized (by the company) as the work related to people's life and safety and essential services, power plants should directly employ them as their employees or as long as they work for the private companies, their basic labor rights should be guaranteed."
