It is criticized that while GM Korea is avoiding the liability of the employer, it uses an indirect way to restrict the basic labor rights of irregular workers.

According to the labor circle, GM Korea sent out an official letter to DH Indus, one of eight subcontractor companies on November 7, with a claim(see the photo) reading that "we suffered an enormous production loss caused by your company." GM Korea singled out the strikes led by the GM Korea Changwon Irregular Workers Union Local of the Korean Metal Workers' Union for the cause of the damages. The union local staged 10 partial strikes last month, calling on GM Korea for direct employment and opposing the insourcing plan for four processes including the vehicle-body installation.

The Supreme Court made a verdict recognizing the illegal use of dispatched workers by GM Korea and ordering GM Korea to directly employ the subcontracted workers in 2013 and last year, but GM Korea did not carry out the court decision.

GM Korea instead announced its insourcing plan of four processes which had been contracted out to subcontractor companies. Insourcing means the dismissal of irregular workers. GM Korea claimed that the production loss of 2,002 units in vehicle-body installation, 2,291 units in painting and 1,764 units in assembling were incurred due to the strikes of the local union, worth of 1,636 million won(US$ 1.46 million). GM Korea also claimed for the damage compensation against Chunbo, a first-band of the subcontractor company with an amount of 984 million won(US$ 0.88 million), citing the same reason.
