According to the Korea-EU FTA, "the parties commit to respecting, promoting and realizing, in their laws and practices, the principles concerning the fundamental rights, namely: (a)freedom of association and the effective recognition of the right to collective bargaining; (b) the elimination of all forms of forced or compulsory labor; (c) the effective abolition of child labor; and (d) the elimination of discrimination in respect of employment and occupation."

Whereas EU ratified all of 8 ILO core conventions covering from the clause (a) to clause (d), Korea has not yet ratified 4 conventions on clause (a) and clause (b). Panelists criticized that the Korean government does not have any further commitment to the improvement of fundamental rights guaranteed by the international labor standards.
